|Every tour participant is required to accurately complete and sign a Release of Liability, Assumption of All Risks, Arbitration Agreement with Boulder Area Bicycle Adventures BEFORE they begin their tour. They are also required to complete the Liability Release Waiver required by the bike rental shop. Failure to complete such form, or if the form is altered in any way, Boulder Area Bicycle Adventures reserves the right to consider such reservation canceled, and there will be no refunds. Children under the age of 18 years who participate in a Boulder Area Bicycle Adventures tour must have their waiver signed by their parent or legal guardian.
Rates & Payment Policy
Boulder Area Bicycle Adventures tour prices are per person, in only United States currency, and are fixed regardless of foreign exchange fluctuations or number of participants in a particular group or organization, except as noted under discounts stated in our FAQ’s section. Boulder Area Bicycle Adventures reserves the right to increase or otherwise change pricing at any time. However, tour participant is guaranteed the price listed on the tour once they have reserved and confirmed their participation and their payment is processed successfully, in full.
Boulder Area Bicycle Adventures reserves the right to cancel your trip and resell your space if your final payment has not been received by the due date, which is at least 72 hours (3 days) prior to the tour date and time selected.
Boulder Area Bicycle Adventures is not responsible for any additional costs for purchases such as transport/travel to and from the start/finish of the tour, incidentals such as food, beverage, souveniers, gifts, or any other retail purchases, or any other incidental expenses.
CANCELLATIONS AND REFUND POLICY
Our cancellation policy requires a 72-hour (3 day) advance notice in order to receive a full refund, less a NON-refundable fee of 10% of the tour price for credit card processing and handling. There are NO refunds if the cancellation occurs within fewer than 72 hours, unless cancellation of tour occurs as a result of a decision made solely by Boulder Area Bicycle Adventures.
Cancellations made by Boulder Area Bicycle Adventures
Once your paid reservation has been confirmed by Boulder Area Bicycle Adventures, our intention is to provide the tour you have chosen in its fullest, as advertised. Though our foremost intention is to provide you with the tour you have chosen, we do, however, reserve the right to cancel any scheduled tour for any reason at any time. You do have the option of taking an alternative tour on a different day or time at no extra cost and we will be happy to arrange that for you. Should a tour be cancelled by Boulder Area Bicycle Adventures and no other tour options are available, we will refund IN FULL all monies paid by your/your group. In addition to a full refund, we will provide you with a credit voucher worth 25% off the value of a future tour within 2 years of the originally reserved tour, regardless of the value of such tour. In the event of such a cancellation and refund by Boulder Area Bicycle Adventures, we shall be released from any further liability.
Boulder Area Bicycle Adventures reserves the unilateral right, at the discretion of the tour operator or guide, to not accept or retain any tour participant whose condition or general behavior obstructs or hinders the operation of the tour, or endangers, or otherwise negatively affects the welfare, enjoyment, or rights, of the other participants on that tour. REFUND POLICY: Tickets are non-refundable if:
LOSS, DAMAGES AND RESPONSIBILITY
Our intention is to make a Boulder Area Bicycle Adventures tour safe and enjoyable for all participants. However, there are certain risks, losses, and damages inherent in bicycle riding and on such tours. Boulder Area Bicycle Adventures assumes no responsibility or liability for any claims that arise as a result of such risks, including, but not limited to: Any loss or damage to person or personal property and belongings; loss or damage to equipment rental including: bikes and related rental equipment as part of the tour; injury to self or others due to participants’ negligence, any accident, or mechanical failure; or any loss, damage, delay, injury or death as a result of criminal activity, accidents with or as a result of collision with other bicyclists, pedestrians, animals, debris, any type of vehicle; lack of medical care, or for any other cause that is beyond the control of Boulder Area Bicycle Adventures and its representatives. In addition, it is the sole responsibility of each participant to be aware of their physical abilities or limitations and to select a tour that suits their health condition, fitness level/ability, and any other condition that might affect their capacity to safely participate in the tour in which they have selected.

We at Boulder Area Bicycle Adventures reserve the right to take photographic or film records of any of its tours, and to use any such photographic or film records for promotional and/or commercial purposes.
All terms and conditions herein are valid for the calendar year of 2010.
